General Terms and Conditions of Sale
ARTICLE ONE – Scope
The “wattiz.fr” online shop was created and is operated by the company SARL LSNR.
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by SARL LSNR with non-professional buyers wishing to purchase the products offered for sale by the Seller on its website wattiz.fr.
These terms and conditions apply to the exclusion of all other terms and conditions, in particular those applicable to in-store sales or to sales through other distribution and marketing channels.
These General Terms and Conditions of Sale are available at all times on this website and shall prevail, where applicable, over any other version or any other conflicting document.
Unless proven otherwise, the data recorded by SARL LSNR shall constitute proof of all transactions.
In accordance with Article L.111-1 of the French Consumer Code, the content of “wattiz.fr” enables the customer, before placing an order, to know the essential characteristics of the product or products selected.
Product offers are valid while stocks last. Information on product availability is provided when the order is placed.
Amendments to these General Terms and Conditions of Sale are binding on users of the website from the time they are published online and cannot apply to transactions concluded previously.
Confirmation of the order by the buyer constitutes unreserved acceptance of these General Terms and Conditions of Sale.
ARTICLE 2 – Right of withdrawal
In accordance with the provisions of Article L 121-21 of the French Consumer Code, the Buyer has a period of 14 business days from delivery of the products to inform SARL LSNR of their intention to exercise their right of withdrawal. The Buyer must then return the products to the Seller for exchange or refund, provided that the products are returned in their original unopened packaging and in perfect condition within 14 days of notifying their decision to withdraw. Items that are damaged, opened, used, soiled or incomplete will be neither refunded nor exchanged. Return costs shall be borne exclusively by the Buyer. Returned products must be accompanied by the invoice. The refund will be made within 14 working days of receipt by the Seller of the items returned by the Buyer. The refund will be made using the original payment method, by bank card, PayPal or bank transfer.
Any request to SARL LSNR may be made by email to contact@wattiz.fr
Any product to be exchanged or refunded must be returned complete (including accessories and instructions) and in its original packaging in perfect condition, by registered Colissimo with insurance covering the market value of the returned products, to the following address: SARL LSNR, boulevard d’Europe, 14540 Bourguebus, FRANCE.
ARTICLE 3 – Order confirmation
It is the Customer’s responsibility to select on the website the products they wish to order.
Any order form signed by the customer by “double click” constitutes irrevocable acceptance, which may only be called into question in the cases exhaustively provided for in these general terms and conditions of sale, such as the right of withdrawal and stock shortages.
Under the Act of 13 March 2000 on electronic signatures, as soon as the customer registers their order or “double clicks” on any order form, the customer’s order is deemed to have been accepted knowingly and to be irrevocable, as regards prices, volumes and quantities alike.
Acceptance of the order is subject to payment and to the receipt of that payment in full.
If the Customer cancels the order after its acceptance by the Provider, beyond the 14 days resulting from the right of withdrawal, for any reason whatsoever other than force majeure, a sum equal to 10% of the total invoice shall be retained by the Provider as damages, in compensation for the loss thus suffered.
Given the large number of orders to be processed every day, and in order to meet occasional needs, Wattiz still allows items to be added to an order, but subject to the following rule: if the customer wishes to add one or more products to an order already placed, a new order must be placed. The shipping costs of this additional order will only be refunded if the order pickers have time to add the items. If this has not been possible, the order will be shipped as a normal order.
ARTICLE 4 – Prices
Products are supplied at the prices in force shown on the website when the order is registered by the Seller. Prices are expressed in euros, all taxes included (incl. VAT).
These prices are firm and not subject to revision during their period of validity, as indicated on the Seller’s website. They do not include handling, dispatch, transport and delivery costs, which are invoiced in addition.
An electronic invoice is issued by the Seller and sent to the customer at the email address the customer has provided to the Seller.
SARL LSNR reserves the right to cancel any orders on which prices or availability are incorrect as a result of a computer bug, hacking, input error or other malicious act from inside or outside the company. SARL LSNR shall be required to inform the customer, cancel the order and, where applicable, issue a refund. The refund will be made using the original payment method, by bank card, PayPal, Bitcoin or bank transfer. If you notice an error, please contact us by email at contact@wattiz.fr.
ARTICLE 5 – Terms of payment
The price is payable immediately and in full on the day the Buyer places the order.
SARL LSNR offers the buyer various methods of paying for their order, as listed on the order form, namely: bank card with secure one-off payment, PayPal, PayPal Express, bank transfer, cryptocurrencies, and bank card with secure payment in 2, 3 or 4 instalments. The latter payment method is governed by the contract below, and its use constitutes full and complete acceptance of the terms of the contract detailed below.
ARTICLE 5 – Terms of payment
The price is payable immediately and in full on the day the Buyer places the order.
SARL LSNR offers the buyer various methods of paying for their order, as listed on the order form, namely: bank card with secure one-off payment, bank transfer or direct debit.
One-off bank card payments are debited when the order is placed.
Any order paid by bank transfer will only be processed once payment has been received. Availability and dispatch times must be recalculated from the date on which the payment is received.
Direct debit is an option that SARL LSNR may offer its customers once, firstly, the customer has made their first purchases (10 or more) by bank card or bank transfer and, secondly, the company concerned has been in existence for 3 years or more.
Should a direct debit be rejected, SARL LSNR will require the customer to pay by bank card. Such a rejection will automatically result in the suspension of payment by direct debit; direct debit will be reinstated once the outstanding invoices have been settled. A fee of €6 excl. VAT will be charged for each rejected direct debit.
SARL LSNR reserves the right to suspend all order processing and all deliveries if officially accredited bodies refuse to authorise payment by bank card, or in the event of total or partial non-payment.
In particular, SARL LSNR reserves the right to refuse to make a delivery or to fulfil an order from a customer who has not paid for a previous order in full or in part, or with whom a payment dispute is being dealt with.
SARL LSNR cannot be held liable for any misappropriation or fraudulent use of any means of payment that has not been detected by the verification procedure.
SARL LSNR retains full ownership of the products sold until all sums owed by the customer in connection with their order, including costs and taxes, have been received in full.
The transfer by the customer to a third party of ownership of goods purchased from SARL LSNR will not be taken into account by SARL LSNR.
Only the original buyer of the goods may claim the benefit of the clauses of these general terms and conditions of sale.
Failure to perform any of these clauses of the contract, in particular non-payment of a single instalment on the agreed dates, or any false or inaccurate statement on your part relating in particular to your civil status and bank details, will make the outstanding balance immediately due and payable, bearing interest at the statutory rate from the date of the formal notice.
Furthermore, any established payment incident may result in registration on the national register kept by the Banque de France.
In the event of non-payment, SARL LSNR, in its capacity as creditor, may, after a simple formal notice to pay has remained unanswered, initiate recovery proceedings against the buyer.
Jurisdiction
Any dispute relating to this contract shall fall within the jurisdiction of the courts of the place where SARL LSNR has its registered office.
Availability of the instalment payment option
ARTICLE 6 – Shipping / Delivery
6.1 General conditions
Dispatch times depend on the type of payment chosen by the customer, as the order is only prepared once payment has been received and cleared.
If an ordered product is unavailable, in particular due to our suppliers, the buyer will be informed as soon as possible and SARL LSNR reserves the right to cancel the customer’s order in full or in part and to refund the corresponding amounts. The refund will be made using the original payment method.
As information on product availability is provided by our suppliers, the unavailability of a product cannot give rise to any liability on the part of SARL LSNR nor entitle the customer to damages.
Except in special cases or where one or more products are unavailable, the products ordered will be delivered in a single shipment.
Deliveries are made by an independent carrier chosen by the buyer:
For mainland France, Corsica and Monaco: Colissimo 2 to 3 business days, Chronopost 24 to 48 hours, FedEx 24 to 48 hours, GLS 48 to 72 hours.
International: delivery in 2 to 7 business days by Chronopost, FedEx or GLS depending on the destination.
French overseas departments and territories: delivery in 3 to 8 business days by Chronopost
Heavy and bulky parcels will be shipped by a specialist carrier, and the delivery time may therefore be longer.
Parcels are shipped on the day of the order or the following day, except on Saturdays and Sundays (when the company is closed). The cut-off time for same-day dispatch is 14:00.
Delivery times are given for information only, based on the data provided by the carriers, and do not constitute a promise of sale. SARL LSNR cannot be held liable for any delay in delivery caused by the carrier.
If the actual delivery time exceeds 14 days (excluding force majeure, public health emergencies or natural disasters) from the time the order leaves its premises, SARL LSNR undertakes to refund the shipping costs to the Buyer upon simple request. The sums paid by the Buyer will then be returned to them, excluding any compensation or deduction, in accordance with Article L111-1 of the French Consumer Code. The refund will be made using the original payment method, by bank card or bank transfer.
In the event of a special request by the Buyer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Seller, the related costs will be invoiced separately as an additional charge, on the basis of a quotation accepted in advance in writing by the Buyer.
Products are delivered to the address given by the customer on the order form.
The customer must check that the information they provide to SARL LSNR is complete and accurate. SARL LSNR cannot be held liable for any input errors or for their consequences in terms of delayed or incorrect delivery. In this context, all costs incurred in reshipping the order shall be borne entirely by the customer.
SARL LSNR cannot be held liable for delivery delays due to errors in the address or telephone details provided by the buyer, or in the event of force majeure (natural disaster, public health emergency, etc.).
The customer is required to check the condition of the packaging and of the contents of the goods on delivery. Any anomaly concerning the delivery (damage, product missing compared with the delivery note, damaged parcel, broken products, etc.) must be recorded on the receipt of the consignment note in the form of “significant and complete handwritten reservations”, together with the customer’s signature, in the presence of the delivery driver. For shipments sent by La Poste or Chronopost, if the parcel arrives open or damaged, the customer must have the postman or their local post office draw up a “report of tampering” (report 170) so that SARL LSNR can open an investigation and a compensation procedure.
At the same time, the customer must confirm this anomaly by sending the carrier, within two (2) business days of the delivery date, a registered letter with acknowledgement of receipt setting out the said claims.
The customer must simultaneously notify SARL LSNR by sending a copy of this letter (with the original “report of tampering”, where applicable) to: SARL LSNR, boulevard d’Europe, 14540 Bourguebus, FRANCE or by email to contact@wattiz.fr within two working days. After this period, and if these formalities have not been complied with, no claim can validly be accepted by the Seller.
Depending on the delivery location, special promotional offers and the order amount, the customer may be eligible for free delivery, subject to conditions. These conditions will be specified at the time of the said promotional offers. Certain products are not eligible for free delivery due to their weight or size. A flat-rate contribution per unit is then charged to the customer when ordering (this information is shown at the bottom of the description of the products concerned)
6.2 Specific conditions for dropshipping
SARL LSNR permits dropshipping in France and abroad under certain conditions.
1. The customer is solely responsible for the information entered when ordering. Any parcel returned to our warehouse for a reason attributable to the end recipient or to an input error by the customer (incomplete address, parcel not collected, delivery refused, etc.) will result in return charges being invoiced, to be borne exclusively by the customer (reseller).
These charges correspond to the cost of returning the parcel, as invoiced by the carrier, and of issuing the return slip.
2. While delivery times are given for information only, a delivery delay cannot result in either cancellation of the order or compensation as long as the product is in transit.
3. If delivery is urgently needed, the customer must place a new order. SARL LSNR will only cover a new shipment on condition that the carrier has acknowledged the loss of the parcel and approved the claim.
4. If a parcel is declared lost, or declared delivered without having been received, an investigation is opened with the carrier. A replacement or refund will be offered depending on the outcome of the investigation carried out with the carrier.
5. If a problem is encountered with the product(s), the customer is the sole point of contact. Requests from the recipient will not be processed, as all requests must be made by the shop that made the purchase.
6. In addition to transport costs, each return will be subject to a handling fee of €3, which covers:
- receipt and identification of the parcel
- technical inspection of the spare part (checking that it is in new condition and has not been fitted)
- administrative processing of the file (credit note or reshipment)
These handling fees are borne in full by the customer and will systematically be deducted from the credit note issued.
6.3 Refund or reshipment arrangements
In the case of a credit note, the amount will be calculated on the basis of the price of the part excluding VAT, after deduction of the return charges and handling fees mentioned above.
Condition precedent for reshipment: the parcel will be kept on hold at our warehouse. Failing payment and instructions from the customer within 15 calendar days of receipt of the return, the goods will be deemed abandoned. They may then be returned to stock or destroyed, without the customer being able to claim any credit note or compensation.
ARTICLE 7 – Delivery errors – Non-conforming products – Product returns – After-sales service
7.1. Liability
- After-sales service is one of our key commitments. However, as distributors, we are bound by and strictly apply the manufacturers’ return conditions.
7.2. Products purchased in error
- Products ordered in error (incorrect diagnosis, wrong reference, etc.) may be returned within 15 days of the purchase date, provided that the product is still sold on Wattiz. After this period, they cannot be taken back under any circumstances. Only batteries and controllers purchased in error will not be taken back, regardless of the purchase date.
- The return request must be made via the “My tickets” section of the personal account dashboard. It is essential to state “purchase made in error” as the reason for the return.
- Products must be in perfect condition and must never have been used. In addition, the outer packaging must also be in perfect, as-new condition and bear no writing, prices, labels, etc.
- Shipping costs are borne by the customer.
- Any return of a working product (purchased in error) through a standard warranty procedure will be refused.
- Returns of products as “purchased in error” are only possible for spare parts. Other products (tools, accessories, etc.) cannot be taken back on these grounds.
7.3. General procedure
*A part return must be preceded by the creation of a return request via your customer account, which must then be approved by the after-sales service. Any return of goods made without a form or with a manually completed form cannot be processed by our departments. Parts must be returned only to the company’s address at Boulevard de l'Europe, Bourguébus (14540).
*Products from the clearance category will be neither taken back nor exchanged.
*If the parts received do not strictly match the form (missing part, wrong reference, etc.), processing of the entire return is immediately suspended pending further information from the customer.
*Warranty stickers or stamps on spare parts must not be removed or damaged under any circumstances. A part cannot be accepted under warranty if it does not bear the original warranty seal.
*The risks relating to the shipping of the after-sales parcel are the customer’s responsibility.
*The processing time is a maximum of 5 working days after receipt of the parcel. This time may be extended in the event of exceptional circumstances: department holidays, peaks in activity, absence of one or more members of the dedicated team, etc.
*A return handled by us triggers the sending of a return label. The customer has 15 days from the date the consignment note is issued to send us the product(s). After this period, the label will no longer be valid and the return will be at the customer’s expense.
*The value used for the product will be its value on the date the credit note is issued (and not that of the original purchase), so that the customer can directly reorder the same product. However, the refund value may not exceed the purchase price of the product.
7.4. Handling of anomalies
- We strongly recommend requesting, in the return form, that parts not accepted be sent back. If this is not done, the return of the parts can no longer be requested after processing.
- Any claim must be made within 5 working days of the processing of the warranty parcel. After this period, parts not accepted will be destroyed and no claim will be considered.
- Any non-compliant parcel (RMA not created or not compliant) will be kept for a period of 20 working days. After this period, the parts will automatically be destroyed and cannot be covered in any way.
7.5. Spare parts warranty
- Spare parts with a manufacturing defect must be returned in perfect condition and show no scratches or signs of use of any kind (in particular glue or adhesive). Protective films must be present, in particular on displays.
- The warranty period for our spare parts depends on the type of part. It is specified in the warranty conditions
- No Product can be accepted under the manufacturer’s warranty if it shows any damage whatsoever (impact, deformation, oxidation, etc.).
The warranty covers normal use and correct installation.
Our products are covered by the warranty provided that the fault is due to a manufacturing defect and not to misuse or mishandling.
Any significant modification of the products may cause a failure and voids the warranty
Any trace of oxidation/moisture will void the warranty.
7.6. Warranty period for wear parts
7.6.1 Legal warranty
- In accordance with Articles 1641 et seq. of the French Civil Code, the seller is bound by the warranty against hidden defects in the item sold which render it unfit for its intended use, or which so impair that use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them.
It should be noted that the provisions relating to the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) do not apply to sales concluded between professionals.
7.6.2 Commercial warranty Products sold by LSNR WATTIZ are covered by a contractual warranty against manufacturing and material defects for a period that varies by product, starting from the invoice date, unless otherwise specifically stated on the product page or quotation. The warranty is strictly limited to the replacement of the product deemed defective or, where replacement is not possible, to the issue of a credit note for the amount originally invoiced. Implementation of the warranty does not have the effect of extending its duration.
7.6.3 Warranty period and exclusions Technical & structural parts: 12 months (chargers) Technical & structural parts: 6 months (motors, controllers, frames and structural metal parts, personal protective equipment (helmet, etc.), displays, dashboards
Technical & structural parts: 3 months (throttles, triggers (NFC, key), lighting)
Battery & accessories: 3 months (batteries, BMS, miscellaneous accessories (phone holder, luggage, etc.)
Wear parts (consumables): on unpacking (tyres, inner tubes, brake pads, discs, rubber grips – warranty limited to manufacturing defects identified before fitting)
7.6.4 Specific conditions of applicationBatteries: the 3-month warranty covers manufacturing defects only (defective cell, faulty BMS). It is excluded in the event of deep discharge (voltage below the critical threshold), prolonged storage without charging, or any trace of moisture. Electronic parts (motors, controllers, chargers, throttles): the warranty is automatically void in the event of any trace of oxidation, corrosion or water ingress, regardless of the product’s theoretical ingress protection (IP) rating. Cutting cables or modifying connectors voids the warranty.
Frames and metal parts: the warranty covers welding or casting defects. It does not cover breakage, cracks or twisting resulting from impacts, falls or stunt riding (jumps, freestyle).
7.6.5 General exclusions
The commercial warranty does not apply in the following cases:
- incorrect fitting: installation carried out without complying with fitting rules or technical recommendations
- modification of the vehicle: installation on an e-scooter that has been derestricted or whose electrical characteristics have been modified
- normal wear and tear: cosmetic deterioration, scratches or natural loss of battery capacity due to charge cycles
- lack of supporting documents: failure to produce the purchase invoice or the seller’s invoice
7.6.6 Return procedure
All warranty returns require prior approval. Return shipping costs to our warehouse are borne by the customer. If the defect is confirmed and covered by the warranty, the seller will, at its discretion, repair or replace the defective part or issue a credit note for it.
7.6.7 Limitation of liability
As a professional reseller of spare parts, the buyer acknowledges that it is solely responsible for diagnosing the fault and choosing the part ordered.
Except in the event of proven fault on the part of the seller, the seller’s liability is expressly limited to the purchase price of the disputed product. Under no circumstances may the seller be held liable for indirect and/or consequential losses, such as operating losses, loss of customers, loss of profit, or labour costs incurred by the buyer to replace parts.
7.6.8 Receipt and inspection of products (apparent defects)
7.6.8.1 Buyer’s obligations on delivery
As a professional, the buyer is required to inspect the condition and conformity of the products delivered as soon as they are received.
Checking the parcel: the buyer must check the external condition of the packaging. In the event of visible damage (parcel opened, crushed, wet, etc.), the buyer must record precise and substantiated reservations on the carrier’s consignment note and inform the seller in writing within 48 hours of delivery. If no reservations are recorded, the parcel is deemed to have been delivered in perfect condition, with the result that no claim may subsequently be made.
Checking the goods: the buyer must carry out a qualitative and quantitative check of the products inside the parcel.
7.6.8.2 Time limits for claims relating to apparent defects
Any claim concerning an apparent defect (product visibly damaged, scratched or broken), non-conformity of the product delivered with the order (wrong reference or model), or an item missing compared with the delivery note must be sent to the seller within a maximum of 72 hours of delivery.
7.6.8.3 Consequences of failure to make a claim
Once the 72-hour period has elapsed, the products delivered will be deemed to conform in quantity and quality and to have been accepted by the buyer. No subsequent claim for an apparent defect or non-conformity will be admissible.
ARTICLE 8 – Transfer of ownership – Transfer of risk
Ownership of the Seller’s products shall only pass to the Buyer once the Buyer has paid the price in full, irrespective of the delivery date of the said products.
ARTICLE 9 – Seller’s liability – Warranty
In accordance with the statutory provisions, the products supplied by the Seller benefit from the legal warranty of conformity, the legal warranty against hidden defects arising from a defect in materials, design or manufacture affecting the products delivered and rendering them unfit for use, and the Manufacturer’s warranty, depending on the products and brands concerned.
All warranties are excluded in the event of misuse, negligence or lack of maintenance on the part of the Buyer, as well as in the event of normal wear and tear of the item, accident or force majeure, and the Seller’s warranty is limited to the replacement or refund of products that are non-conforming or affected by a defect.
In order to assert their rights, the Buyer must, on pain of forfeiting any related action, inform the Seller in writing of the existence of the defects within a maximum of 8 days of their discovery.
The Seller will replace or have repaired any products or parts under warranty deemed to be defective.
The products sold on the website comply with the regulations in force in France. The Seller cannot be held liable in the event of non-compliance with the legislation of the country to which the products are delivered, which it is the Buyer’s responsibility to check.
The Buyer is solely responsible for the choice of products, their storage and their use.
The Seller shall not be deemed liable or in default for any delay or non-performance resulting from the occurrence of an event of force majeure as usually recognised by French case law.
All electrical equipment supplied in kit form must be connected by a qualified professional electrician. SARL LSNR cannot under any circumstances be held liable if these installation requirements are not complied with.
As an essential condition of the sale, it is reiterated that the Buyer is solely responsible, in particular, for the use of the Seller’s Products, their suitability for the use made of them and their intended purpose. The Buyer shall refrain from any use of the Seller’s Products that would be contrary to public policy, to the requirements of the French Public Health Code and, more generally, to the applicable statutory or regulatory provisions under French and European law.
Article 10: Partial invalidity
If one or more provisions of these general terms and conditions are held to be invalid or declared as such pursuant to a law or regulation or following a final decision by a competent court, the other provisions shall retain their full force and scope.
ARTICLE 11 – Data protection
Pursuant to Act No. 78-17 of 6 January 1978, it is reiterated that the personal data requested from the Buyer are necessary, in particular, for processing their order and drawing up invoices.
The processing of information communicated via the Seller’s website has been declared to the CNIL.
In accordance with the national and European regulations in force, the Buyer has a permanent right of access, modification, rectification and objection with regard to information concerning them.
ARTICLE 12 – Intellectual property
The content of the website is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any reproduction of this content, in whole or in part, is strictly prohibited and may constitute the offence of infringement.
Furthermore, SARL LSNR remains the owner of all intellectual property rights in the studies, quotations, drawings, models, prototypes, etc. produced (even at the Customer’s request) with a view to providing services to the Customer. The Customer shall therefore refrain from any reproduction or use of the said studies, quotations, drawings, models, prototypes, etc. without the express, written and prior authorisation of SARL LSNR, which may make it subject to financial consideration.
ARTICLE 13 – Governing law – Language
By express agreement between the parties, this contract is governed by and subject to French law.
It is drawn up in French. Should it be translated into one or more languages, only the French text shall be authentic in the event of a dispute.
ARTICLE 14 – Disputes
All disputes to which this contract may give rise, concerning its validity, interpretation, performance or termination, and their consequences and aftermath, shall be submitted to the competent courts under ordinary law.
In the event of a dispute with professionals and/or traders, the competent commercial court shall be that of the place of the registered office of SARL LSNR.
ARTICLE 15 – Buyer’s acceptance
The placing of an order on the Seller’s website by a natural (or legal) person entails full and complete adherence to and acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Buyer, who waives, in particular, the right to rely on any conflicting document, which would be unenforceable against the Seller.
